The City of Elizabeth offered Bathgate, Wegener & Wolf’s client, Sumo Elizabeth Company, $22,000.00 for the taking of a river trail and flood control easement within the owner’s property. After a five-day trial, the jury awarded Bathgate, Wegener & Wolf’s client $212,100.00—almost ten times more than the City’s appraisal opinion.
The parties also disputed the amount of interest to which the property owner was entitled on the jury verdict. The City asserted that the owner should receive interest based on the low rates of a tort judgment rule, on a simple basis. However, as Bathgate, Wegener & Wolf successfully argued, the Court calculated the judgment based on the higher prevailing commercial interest rates, on a compound basis. After the jury’s verdict, the City indicated it would not be seeking an appeal and has paid the judgment in full.
